How long you have to file a wrongful dismissal claim is typically 2 years after you were terminated. However, there are some caveats to that as well. So, for example, if there was discrimination on the part of the employer, it’s one year from the date that happened. And if you are a federally regulated employee, if you work for a bank, if you work for a pipeline company or something like that that’s federally regulated under the Canada Labour Code, you have 90 days to file an unjust termination complaint.
